1. Acceptance of Terms
By creating an account, connecting your social media profiles, or otherwise accessing the Fomy.ai website and platform (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you may not use our Services.
2. Account Registration & Security
To use certain features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately at founders@fomy.ai of any unauthorized access to your account.
3. Content Ownership & License
You retain all ownership rights in the text scripts, voice samples, imagery, and other content you upload or submit to the Services (“User Content”). By uploading User Content, you grant Fomy.ai a worldwide, non-exclusive, royalty-free, fully paid-up sublicensable license to host, store, process, modify, and reproduce your User Content solely as necessary to perform and generate the Services for you (such as generating your digital avatar videos and auto-publishing them to your connected social channels).
4. AI Avatars & Content Policy
You may only train and generate AI avatars using your own likeness, voice, and media, or likenesses for which you have received express, written, legal consent. You agree not to use the Services to generate deepfakes, misleading media, or unauthorized representations of third parties. Fomy.ai reserves the right to terminate accounts that violate this policy without refund.
5. Fees, Billing & Refunds
Certain parts of the Services are provided on a paid subscription basis. Subscriptions are billed in advance on a recurring monthly or annual cycle. Subscriptions will automatically renew under the same conditions unless canceled. You may cancel your subscription at any time through your account billing panel. Fees are non-refundable except as required by law or as expressly stated in our refund policies.
6. Prohibited Conduct
You agree not to:
- Use the Services for any illegal purpose or in violation of local, state, national, or international laws.
- Post or generate content that is hateful, defamatory, threatening, or sexually explicit.
- Interfere with or damage the operation of the Services, including via virus uploads, denial of service attacks, or scraping.
- Attempt to reverse engineer, decompile, or copy any software or algorithms used by the platform.
7. Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will cease immediately.
8. Disclaimers & Warranties
The Services are provided on an “AS IS” and “AS AVAILABLE” basis. Fomy.ai makes no warranties, expressed or implied, regarding the reliability, uptime, accuracy, or quality of the AI generated videos or automatic publishing pipelines.
9. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Fomy.ai or its founders be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of your use of or inability to use the Services.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in San Francisco, California.
